Here is what we know about the status of 49ers linebacker Reuben Foster in light of his troubled offseason:
Days since arrest: 10 (on Feb. 11).
Allegations: Domestic violence (273.5 (a) PC), threats (4222 PC), possession of an assault weapon (30605 PC). His girlfriend accused him of physically dragging her during an argument at a Los Gatos home, this newspaper learned from sources. The extent of her injuries, if any, have not been disclosed.
Charges: None filed yet from the Santa Clara County District Attorney’s Office. Prosecutors have up to 30 days to decide on whether to file charges. All three alleged offenses are known as “wobblers,” meaning that if they are charged, they can be filed as either misdemeanors or felonies based on the discretion of the District Attorney’s Office or a Superior Court judge.
Police report: The Los Gatos Monte Sereno Police incident report is not public until the case is closed, which doesn’t happen until charges, if any, are filed.
911 call: The reported victim, who had been in a relationship with Foster for several years, also told police dispatchers he owned multiple semiautomatic rifles.
Weapon: A SIG Sauer 516 short-barreled rifle, sources said. It’s unknown if it is properly registered with California’s gun laws.
Bail: He was released on $75,000 bail on Feb. 11 from Santa Clara County Main Jail.
Investigations: The Santa Clara County District Attorney’s Office is still reviewing the case, as is the National Football League security division and possibly an independent investigator. Foster is believed to be cooperating with investigators, according to a source.
League policy: Any investigation into a personal-conduct-policy violation may be conducted by NFL security, independent parties, or by a combination of the two. In cases that are also being investigated by law enforcement, the league will work to cooperate with and to avoid any conflict or interference with the law
enforcement proceedings. Anyone arrested for the first time for alleged domestic violence is subject to a six-game suspension, regardless if criminal charges are filed.
49ers options: Other than releasing him one year into a four-year, $9 million contract, the 49ers can not suspend or discipline him, which only the league can do under its personal-conduct policy. The 49ers can talk with Foster (but not about football) and look into the matter with law enforcement, but the investigation is up to the league and prosecutors.
Foster’s 49ers status: He is allowed to work out at the team facility, which he’s done the past few weeks since returning from his native Alabama. Coaches and staff are not allowed to discuss football matters with players until the offseason program begins in mid-April.
Public comments: Neither Foster nor his alleged victim have commented publicly. The 49ers, on the night of his arrest, issued a blanket statement from the organization rather than general manager John Lynch, coach Kyle Shanahan or ownership: “The San Francisco organization is aware of the matter involving Reuben Foster and we are currently gathering all relevant facts.”
Alabama arrest: Foster got arrested Jan. 12 for second-degree marijuana possession (for personal use rather than sale) in Tuscaloosa, home of his alma mater, the University of Alabama. Bond was posted at $2,500. His initial hearing is set for Feb. 28 in Tuscaloosa County.
Foster’s history: Foster is already in the NFL’s substance-abuse program, having acknowledged last year he failed a drug test because of a diluted sample at last February’s scouting combine, from which he was sent home early for arguing with a hospital worker.
